Family Files Wrongful Death Lawsuit Against Gold Club

The family of a waitress who was killed while driving under the influence on her way home from work last summer has sued the woman's former employer. When a wrongful death takes place, the responsible party may be held liable to the deceased person's immediate family members.

    January 08, 2012 /Government PR News/ -- The family of a waitress who was killed while driving under the influence on her way home from work last summer has sued the woman's former employer. In its wrongful death claim against Gold Club, an exotic dancing establishment, the family of Ashley Hollyfield claims that the club encouraged its employees to drink alcohol on the job as a way to increase profits. According to the lawsuit, the club continued to provide Ms. Hollyfield with alcoholic beverages after she was clearly intoxicated, and later allowed her to drive home under the influence of alcohol.

In legal terms, a "wrongful death" occurs when someone is killed as a result of the misconduct or negligence of another person or entity. This may occur under many different circumstances, including but not limited to the following situations:
- Vehicle accidents
- Workplace hazards
- Criminal conduct
- Medical malpractice

When a wrongful death takes place, the responsible party may be held liable to the deceased person's immediate family members. Generally speaking, immediate family includes the spouse or children of the deceased person, although in some cases it may also refer to the parents of the deceased.

If a wrongful death suit is successful, the family of the deceased may be able to receive compensation for the financial losses resulting from the death, including lost income, support and services, as well as recovery of any related medical or funeral expenses. In cases of extreme misconduct or recklessness, the court may also award additional damages known as exemplary damages. These awards go beyond mere compensation, and are used by the courts as a deterrent to other parties against engaging in the same conduct that resulted in the death.
